Buyer Agrees:
HEALTH : Seller states that the puppy you are
purchasing is healthy at the time of sale. For purpose of the
agreement, once the puppy leaves the seller's premises, it is under
buyer's control. Notice of any problem with said puppy must be
received within 48 hours in the manner described below.
1) Buyer agrees to have the puppy examined by a reputable
veterinarian within 48 HOURS from the time of the purchase.
A Letterhead from the veterinarian must be returned to the seller
immediately following the examination. Failure to return written the
letterhead within 24 hours of exam invalidates this contract.
This letterhead may be faxed to 605-698-7596. If this veterinarian
establishes a MAJOR problem (internal, external parasites and kennel
cough excluded) with the puppy upon initial examination, puppy may
be returned at this time.
2) If puppy is being purchased as pet only, papers will not be
released until the buyer has provided the seller with documentation
from the veterinarian that the puppy has been altered from breeding.
Failure to comply with agreement voids all guarantees.
3) Puppy is guaranteed for 1 year from date of purchase against
genetic defects.
4) ALL VETERINARIAN EXPENSES ARE THE RESPONSIBILITY OF THE PET
OWNER.
Although we have no known problems with our breed lines, I
encourage all new owners to keep me informed concerning the
development of any Cavalier obtained from us and any problems that
may develop during its lifetime.
Breeder Agrees:
1) That buyer is purchasing a purebred puppy with limited AKC
registration. The registration papers will be withheld until proper documentation is
received from veterinarian for pet only puppy.
2) Breeder guarantees that puppy has been checked by a
veterinarian. Puppy has received its first shots and has been
wormed. Medical reports will be furnished at time of purchase.
If puppy is being shipped, shots and worm records will be with
puppy. If within 48 HOURS of receiving the puppy and he/she is
examined by a reputable veterinarian and the health of the puppy is
found to be at risk do to a congenital defect (existing at birth),
owner shall notify breeder and provide a written statement from a
licensed veterinarian describing puppy's condition and shall return
the puppy and papers to the breeder within three days of the
examination. Breeder will replace puppy or refund money
provided puppy is in the same condition mentally and physically as
when originally purchased. This does not include worms, fleas.
mites, cocci, giardia, or any other parasites as they are common in
dogs and puppies.
3) Breeder is not responsible if puppy contracts a communicable
disease after leaving breeder's possession.
4) Breeder guarantees puppy against any congenital defect causing
death of or making necessary euthanasia until one year of age.
Puppy is guaranteed from Mitral Valve Disease for a period of one
year.
5) Upon receipt of a letter to breeder from a reputable
veterinarian stating that in his/her opinion this condition is
congenital, puppy will be replaced by a puppy of equal value at
breeder's convenience.
6) To be covered by this guarantee, the following conditions need
to apply:
A) Puppy must be owned by Original owner
named in this agreement
7) In the event of death of puppy within the 48 hour guarantee
period, Buyer will take the deceased puppy to a veterinarian of his
choice for the purpose of an autopsy at BUYER'S expense. The
deceased puppy must be returned with a statement from the
veterinarian with cause of death. If the puppy died of natural
causes of a warrantable condition, a replacement puppy will be
provided to Buyer. However, if trauma or neglect is found to
play a role in the demise of the puppy in any manner or fashion,
then no exchange will be forthcoming. Additionally, Buyer
agrees to hold Seller harmless for such. Puppies are not
exchanged for any other reason.
This agreement is made and entered into the State of South Dakota
and shall be enforced and interpreted under the laws of this State.

Returns:
Seller will consider a replacement puppy only if
the conditions detailed in this agreement are met. If
the puppy has not visited the Veterinarian as agreed, within the
48-hour time frame, the Seller immediately following exam has not
received a Veterinarian report, NO exchange will be considered.
Limitations of Guarantee:
The guarantee is non-transferable. The puppy
must be in good physical condition. No replacement will be
given if female has been bred. A licensed veterinarian must do
all laboratory verifications. The buyer/owner is responsible
for any and all veterinarian expenses. The breeder is not
responsible for any and all veterinarian expenses accumulated on
return or replaced dog or puppy.
